Scott E. Atkinson
Mr. Atkinson is a civil litigator. He has litigated matters involving breach of contract, fraud, employment discrimination and retaliation, real estate, antitrust, insurance coverage and bad faith, and financial elder abuse. He has experience managing e-discovery and has advised clients on document retention policies and practices.
Prior to joining Carr McClellan, Mr. Atkinson was a litigation attorney at O’Melveny & Myers in San Francisco. He served as a judicial intern to the Honorable Frederick H. Bysshe of the Superior Court of California, Ventura, CA.
Recent experience includes:
- Settled trademark infringement dispute securing all rights to the client's trademark.
- Defended local government entity and officials in employment discrimination and retaliation case. After a two-week trial, the jury found no discrimination.
- Defended semiconductor manufacturer in price-fixing criminal inquiries and antitrust class actions. Defeated class certification in the civil class actions.
- Secured favorable settlement for homeowner in contractor fraud case.
- Defended insurer from claims of bad faith breach of duties to defend and indemnify. The matter successfully settled prior to trial.
- Represented green energy company in breach of contract and fraudulent conveyance action.
- Represented plaintiffs in financial elder abuse, fraud, and rescission action. The matter successfully settled prior to trial.
- Advised Fortune 100 technology company regarding document retention and electronic discovery policies and procedures.
